bianca_gonzalezWas it because it was said in Tagalog? Or was it because popular celebrity babe Bianca Gonzalez (with a “z” at the end) tweeted it? Whatever the reason, an outrage fad was born yet again after the modelling and social media superstar let out this gem on Twitter:

Ang dami nating nagtatrabaho para makaipon para sa prime lot at bahay plus buwis pa. Bakit nga ba bine-baby ang mga informal settlers?

Translated:

“So many people working hard to save to buy a house on prime land while paying their taxes. Why do we have to baby these informal settlers?”

It is an old concept. The simple principle behind Gonzalez’s tweet is rule of law and everyone — whether rich or poor — being subject to it. Quite simply, squatters live on land funded by the hard work of somebody else and put a strain on public works and services funded by somebody else’s tax money. I elaborated on this in a previous article Land ownership Hell: The Philippines is Squatter Central when it comes to government subsidies!. This being the Philippines which aspires to be a First World nanny state (despite lacking the cash to achieve that quaint aspiration), applicable laws to combat squatter infestation have been reduced to toothless drivel since the fall of former President Ferdinand Marcos.

Presidential Decree 772 (PD 772) effected by former President Ferdinand Marcos in 1975 made prosecuting “squatting and other criminal acts” relatively easy. Squatting under PD 772 was clearly a criminal undertaking as Section 1 of the decree states…

Any person who, with the use of force, intimidation or threat, or taking advantage of the absence or tolerance of the landowner, succeeds in occupying or possessing the property of the latter against his will for residential commercial or any other purposes, shall be punished by an imprisonment ranging from six months to one year or a fine of not less than one thousand nor more than five thousand pesos at the discretion of the court, with subsidiary imprisonment in case of insolvency.

And so, under Marcos’s administration, thousands of squatters were successfully evicted from land they illegally inhabited and jailed for their offense.

Unfortunately PD 772 was repealed when Republic Act No. 8368, the “Anti-Squatting Law Repeal Act of 1997″ took effect. RA 8368 also authorised dismissal of all pending cases that drew upon the provisions of the now repealed PD 772. It also directed criminal cases against squatters to defer to the broader “Comprehensive and Continuing Urban Development Program” described by Republic Act 7279, which stipulated sanctions that are applicable only to “professional squatters” which are defined to be…

[…] individuals or groups who occupy lands without the express consent of the landowner and who have sufficient income for legitimate housing. The term shall also apply to persons who have previously been awarded homelots or housing units by the Government but who sold, leased or transferred the same to settle illegally in the same place or in another urban area, and non-bona fide occupants and intruders of lands reserved for socialized housing.

RA 7279 however explicitly excludes from the definition “individuals or groups who simply rent land and housing from professional squatters or squatting syndicates.” These laws, in effect, make the process of removing squatters from one’s property a long and convoluted one.

Well, we sow what we reap, don’t we?

Metro Manila is now a pigsty of a city. Squatters routinely deposit their household sewage into the Pearl of the Orient’s once picturesque esteros. The illegal structures they erect, have long been seen as the single biggest urban blight that contributes significantly to the problem of flooding in the Philippines’ wretched capital. Add to that too all the other illegally-erected structures of businesses backed by local politicians, such as the fish pens that proliferate all over Laguna de Bay. The aroma of raw sewage that engulfs the country’s premier metropolis is unmistakable during the wet season. And during the dry season, the thought of open sewers and where the thick ubiquitous clouds of dust that hang over the city 24 hours a day comes from is enough to discourage anyone from eating ice cream on a cone outdoors.

But because Bianca Gonzalez is a celebrity and because the starstruck society in which she makes her living expects its celebrities to be a “compassionate” bunch, Gonzalez’s tweet made waves. On the venerable pages of that exemplar of journalistic integrity Remate, can now be found the collective expression of indignation of the Filipino underclass

“Kailangan maunawaan ni Bianca ang tunay na ugat ang urban poverty at squatting problem sa bansa. Ito ay isang social responsibility ni Bianca at ng iba pang journalist na tagapag-timon ng public opinion sa bansa,” ani [Gloria Arellano, KADAMAY national chairperson].

Inaasahan ng grupo na pagtatanong lamang ang naging komento ni Bianca. Nakahanda umanong maglinaw ang KADAMAY at sagutin kung talagang bini-baby ng gubyerno ang mga informal settler.

“Pam-bibaby bang maituturing ang libu-libong maralitang pamilyang na itinaboy ng gubyernong Aquino sa panahon ng kanyang panunungkulan at pagdanas nila ng pandarahas ng estado mula sa sapilitang paggiba ng kanilang tahanan, pagkakakulong, pagsasampa ng gawa-gawang kaso hanggang at pagmamaslang sa 13 maralitang tumututol sa demolisyon?” tanong ni Arellano.

Translating the above to the lingua franca of the 21st Century…

“Bianca needs to understand the real roots of urban poverty and the country’s squatting problem. This is a social responsibility of hers and other journalists who shape public opinion.” says Gloria Arellano, KADAMAY national chairperson.

The KADAMAY group (an acronym for the Kalipunan ng Damayang Mahihirap or Confederation for Solidarity Among the Impoverished) hopes that Bianca merely tables a rhetorical question. The KADAMAY group is ready to clarify whether the government is indeed coddling the informal settler community.

“Can we even regard as ‘babying’ the state’s violent demolition of homes, the imprisonment and filing of cases against the 13 who protested this demolition which transpired under the government of President Aquino?” asks Arellano.

Gonzalez has since reportedly expressed to Vencer Crisostomo (chairperson of leftist militant group Anakbayan) her intention to initiate talks with the aggrieved parties.

      Seems to me with the history of PD 772 that many laws today were reactions to the Marcos era, without any consideration for the long-term. All they want to is to “undo Marcos.” After that, then what? Sometimes, laws passed under Marcos are actually beneficial. Then they get repealed just because of association with Marcos, and replaced with more detrimental laws. Laws done the reactive way cause more harm than good.

        I agree… and these lawmakers are nowhere to be found. Just like the booting out of the U.S. bases in 1992. Hastily done without thought, mostly out of false ‘patriotism’. Then we never improved the military since then to make up for the external security that was lost when the U.S. left. Now we have this mess with China and can’t do anything about it.

      May mga pulitikong nasopla sapanahon ni Marcos. Nakita kasi ni Marcos na mga bopols itong mga ‘to, kaya di umubra sa kaniya. Nung napatalsik si Marcos, nag-epalan na ang mga pulitikong ‘to (mga bopols pa rin naman), at nagsigawa ng mga batas na kulang sa pagsusuri, at hindi ginamitan ng matalinong pag-iisip. Isa sa mga pulitikong yan ay si LINA, at si PIMENTEL (SK at absentee voting).

    She DOES have a point. Many Filipinos pay a lot of tax money in order to have living space. We work our asses off. Informal settlers or not, everyone MUST do the same to DESERVE better living space.

          Pag bumibili sila ng gamit sa mall, pag nagpapakalango sila sa alak at yosi na tinda sa kanto, hindi ba may VAT yun?

          Wala nga silang income tax na kinakaltas sa kanila, pero yang mga yan, may VAT pa ding binabayaran; kaso ang VAT na ambag nila, kulang na kulang sa ginagastos para sa kanila.

Sa araw-araw na ginawa ng Diyos na tumatambay sila sa kanto, naglalasing at nagyoyosi ay nagbabayad sila ng buwis! Biruin mo, sa araw-araw na hindi sila naghahanap ng trabaho ay may naitutulong pa rin sila sa pag-unlad ng bansa natin dahil nagbabayad sila ng buwis! Indirectly! Sorry, sorry, I stand corrected.   • It’s not just that baby ang mga informal settler’s.while others doing the hard work,paying taxes just to buy prime house or own houses. Good for you Bianca among other people who are blessed with good job, earned a lots of money to save large, perhaps huge money from the bank and can afford to buy luxurious things and owned a house of your dream among others things and comforts in life, because you have given the gift and opportunity to work or have given chance to have a work, perhaps a descent and good job for you because you have given a chance to finish your study, given a quality education, finish a course and to have a good career because maybe you came from a wealthy or just we say from ordinary family, unlike these people coming from a very poor families- as you say informal settler’s- before they call them professional squatters. My goodness my dear Bianca, you do not what these people only have in their lives, they even omit a meal a day, perhaps nothing to eat because of lacking in life. They only rely on day to day basis, only if they have earned money that day from selling something from the market, only if someone asked their service for massage, laundry, manicure, pedicure or someone to asked them to fix ruin houses. These people have No permanent job, most of them have only extra-job. Good for them if they have. They belong to 2nd-perhaps 3rd-citizen class of Society. Most of them works as factories workers, sales ladies,sales man- most of them are contractual workers-they job good only for six months-good for them if they have given the opportunity to renew their contracts, most of them works only on constructions as carpenter, electricians, house painters-what do you expect of their salary? Big? like you? Most of them if not low salary are underpaid, without benefits like SSS- Philhealth. You only say that things, because you yourself do not experienced what they are experiencing in life. They lived there on poor conditions for such a long time, living along the creeks, under the bridge, near/beside the river or in low-lying areas suffered fro great floods during rainy seasons is very hard for them, they have to be patient and tough enough for life just accept their situations because they have No choice, because if they go back to far provinces specially in Mindanao- my goodness, they will starved to death because of massive poverty and lack of security between the fight of rebels and soldiers. Please be sensitive enough to the situation and needs of others. It’s not unfair, because they deserved it- it their rights as citizens and voters of our Nation. Large numbers of Votes comes from informal settler’s. Politician uses them for their Votes during Elections. You yourself among politicians and Government Leaders and 45-Elite well known families, Hacienderos and Businessmen owned Multi- Corporation have a Moral/Social Responsibility for these people. Social Justice.       Bianca has no reason nor need to empathize with them. Some of these people knowingly abuse the whole system to their gain, much as those above them find their own ways of benefiting from their presence. Others know no better, and the blame there is equally shared between themselves and the government; but then again, there are people who want it that way for their own gain.

      Social justice dictates that the poor, middle class and rich be treated equally in the eyes of the law; and removing them from these places where they endanger others besides themselves is the definition of enhancing the overall good.

      Disincentivize squatting in the first place, for example by not granting the right to vote to those who live on squatted land, not allowing installation of water and electric facilities, and development of outer areas where they can use whatever skills on hand, and you’ll see this problem disappear faster than the snap of fingers.

      You want her to be sensitive enough for the needs of others? Kung ikaw ba nakawan dahil walang makain yung nagnakaw sayo, e okay lang–considering na you’ve worked hard for it?

      You’re kidding aren’t you?

      There are people who were plumbers and employed with “low” jobs, but right now owns their own house, cars and so on because they worked hard and CREATED their opportunities by learning more and making their services more valuable than it was before. It took them about an average of 5 – 10 years just to establish something, and then another 5 – 10 years to reap the rewards.

      These squatters have a choice… unfortunately what they do is that they CHOOSE to be lazy, they CHOOSE to be helpless, they CHOOSE to be poor because “my family has been poor”.

      Therefore, I disagree. These squatters do not deserve sympathy nor support. If some of them can get out of their situation and make a good life for themselves, why can’t others do the same?

      If in case the answer has eluded you, it’s because they CHOOSE not to do anything about it. They’re mindset is that they have already given up. That’s because it’s easier to do so. It’s hard to live in filth, but it’s a thousand times harder to work yourself out of a difficult situation… so most people choose not to. Since the government is coddling them for their votes anyway, and they’re used to filth, why change?

        This so true.. may mga kakilala ako na binibigyan namin ng damit, food, etc. nalaman namin hindi nila pinahahalagahan ang mga bigay sa knila, like sa damit, imbes na labhan after magamit itatapon lng, ang mga toys ng mga bata na natatanggap nila pag pasko tinatapon lang rin pag ayaw na.. this one good example that mashado clang na-baby that they always get things for free, that they don’t try to get decent job as source income dahil alam nilang may magbibigay ng libre. While tayong mga normal ang pagiisip, nagttrabaho ng matino para mabuhay. These people should be punished, ibalik ang PD 772. Hindi ba obvious na mas tumino ang mga tao noon kumpara ngaun na hindi lang squatters ang magnanakaw kundi ilan sa mga tao rin sa gobyerno..

        Good analogy. i had the same philosophy in life. REAP WHAT YOU SOW. Sucess in life comes from hard work, planning. Karamihan sa pinoy, Tamad kaya walang napapala sa buhay. Gusto patanbay tandbay sa kanto. magkuwentong lasing sa isat isa. so shallow. im more compassionate of people who help the,selves to find a better job.       Sa tingin ko sinesansationalize mo lang ung kahirapan ng mga squatter. given na un eh mahirap sila, pero hanggang kelan pagbibigyan? magbigay ka ng specific date. :) malaking porsyento ng squatter ang kaya umupa ng bahay, at namumuhay ng higit sa mahihihrap. PROMISE! at alam ko, na nakikita ni Bianca un kaya nasabi nya un.

      Tip lang: kapag hindi masyadong magaling mag-English, WAG MAG-KUNWARI–magsalita sa Filipino. Hindi naman yata bawal mag-Filipino dito. Baka mas maiintindihan pa ang sinasabi.

      Now that I got that out of the way, on to the main topic: I know people who were really poor as a rat, who hardly had anything to eat, but still lived a life of honor. They didn’t use their poverty as an excuse to STEAL.

      In case it has not occurred to the sympathizers of squatters, these squatters are STEALING. Taking something that doesn’t belong to you with an intent to keep it is a CRIME.

      Yes, they are poor and they need some help. But not to the point that they become too dependent on handouts and freebies from others, not just the government.

      If they want their own homes, then do it like the rest of us: work hard for it.

        1. pabayaan na lang kung nasaan sila
        2. bawiin ang lupa, i-demolish sila tapos bayaan na lang
        3. i-demolish sila at i-relocate
        4. idemolish at ikulong lahat
        5. sunugin at patayin

      Bianca may not be born poor, but she surely worked her ass off just to gain what she has gained and be in the position that she is in today. What Bianca only means is that the government should focus on the people who actually pay their taxes. What about the people who has medical needs, but can’t actually receive them because the government allocate more funds to the people who settle illegally. These illegal settlers should learn their lessons so that they would realize that they should work so that they could afford legitimate living spaces. These people will never learn if the government will continue to fund them. And what do we owe them, really? Aren’t our taxes supposed to be used for us, for those who strive? I feel sad because people emphathize too much for these illegal settlers, that they somehow forget that we don’t owe them, that what we pay is for us, not for other people.

      Actually Bianca has a point and so do you. There are a lot of unfortunate people that really have no place to go. I myself came from that but I worked hard for what I have now. I am not rich but would consider my self deserving of the tax I’m paying. These people also have to learn to find means to survive. To be honest I would see a lot of informal settlers in manila doing nothing sit around but you can tell how healthy and fit they are to work. If they are really eager to earn they could have done something rather than sit around. Also, they demand so much to the government even if they are given enough like houses and assistance which in my level I cannot receive the same privileges as them. Do I complain? I couldnt even buy a house of my own, do I squat? I find means. Sa totoo lang tama si Bianca. Marami nga pinoy nagsstruggle di lang squatters. You’ll be surprised to see their houses complete pa appliances at gadgets. So dapat kung informal settler ka, kaw na ang umalis, dapat nga ipakulong pa for trespassing to be fair sa owner ng land. pero sa case natin narerewardan pa sila ng house diba mas deserving yung may ari ng land na ninakawan ng informal settlers? may sagad talaga sa hirap pero ang di ko makuha they can survive better sa province, they can plant crops para may makain sila. most informal settlers naman may probinsya na pinanggalingan. tama si Bianca, i commend her courage.

      Janette Bautista. kawawa nga ang mga mahihirap.. so teach them to be responsible and stop multiplying..the root of poverty is all about the numbers of mouth poor parents can hardly feed..and produces a new batch..what sensitivity..do not blame the rich like me where the tradition of haard work was passed on from one frugal hardworking parent to another..RH BILL..i have my share of helping the poor..putting one poor to education to another one..pero puta..if they keep on multiplying..there is just no catching up..

Malinis at maginhaang pamayanan ang iyong munisipalidad di ba :-) gamitin ang kokote hindi ang dami!!!!

    wala atang mali sa sinabi ni Bianca, ang hirap mag-isip para magkaroon ng ari-ariaan na talagang masasabing nai-pundar ng isang tao… pero yung mga squatter, mag mamasid lang kung walang nakatingin at ayun, mag titirik na ng tirahan… kalaunan ay protektado na ng Lina Law… ang gusto pa ay sa gitna ng Maynila ang relokasyon… samantalang ako, nag hahanap pa rin ng mabibiling bahay at lupa, huli akong tumingin sa Cavite at mukhang di ko pa kakayanin.

    Tama naman sya.Actually, those settlers have been lucky enough to be provided with a house to move in to sa mga relocation sites and they still complain na wala raw trabaho dun..I think they’re being too much.they have settled many years on properties they don’t own with taxes they don’t pay,and in return they were given a house with very easy and light finance terms,and they still have the nerve to get mad na walang trabahong kasama ang binigay sa kanila.I know Everyone has the right to live decent lives but I think it should also be earned….Just saying.

    Don’t hate Bianca for being rich. Pinanganak na ngang mayaman, nagtatrabaho pa kahit pwede na lang siya na umasa sa magulang. Pero kaming mga hindi ipinanganak na mayaman, we have to work our arse off to earn enough so we can provide for our family and pay for shelter. Ang laki pa ng tax na binabayaran.

    So I agree with Bianca. She has a point. Ang dami lang nagagalit kasi she happens to be rich. But that is not her fault. Karamihan kasi sa mga squatter na yan, bibigyan mo na ng source of livelihood, ayaw pa. Gusto aasa sa doleouts ng gobyerno. Bibigyan mo na ng pabahay, ang daming reklamo. Ang layo daw. Eh kami 2 oras byahe papunta at 2-3 oras pauwi Makati tinitiis araw-araw.

      Correct, I agree with you lalaine. wala sa estado eh kung rich man si Bianca, mahirap ako or sila. the mere fact na binibigyan sila di pa sila satisfied and di pa sila contrite for the fact na nagnakaw sila ng land nakigamit without permission. mali sila sa totoo lang from the very beginning sila yung may ginawang mali. ngayon given na binigyan na sila ng fresh start anu ba naman kumilos sila find means to survive mas better na nga living nila kasi may sariling house sila dinaig pako na sobra na kayod wala pang bahay til now. Sana marealize din ng government na tigil na yung pagcconsider sa mahihirap. maghigpit narin sana sila.

        i agree with corrine, lalaine, and bianca as a whole. we are living in a society where the people have been brainwashed into this rich/poor differences, where the hero is always the under priveleged, and a come-uppance is always underway. it’s the stuff of our daily shows, the daily telenovelas which they rot their brains out on. it is tailored to fit their fantasy, as of course the industry survives on the number of patrons. while the intelligent community knows this is a work of fiction, most of the uneducated does not realize this. i have always been bemused when i hear a lot of my neighbors arguing vehemently about fictional characters from their favorite soap. don’t they have anything else to do? the answer is no. the country is in a stupor, their brains rotting, and the economy failing. this is because the working class is saddled with the burden of providing for the non-working-but-of-age-and-health people. in the end it always boils down to the sheer number of the people. we are overpopulated, ladies and gents, and grossly so. anyone who says otherwise is a fool, as i would not impose it upon the blind to accept these into their predicament. bianca is correct. we cannot afford to be hypocritical about this. i strongly believe that while the conditions of your birth is not your fault, you are still responsible if you remain in that condition for life.

      Tama lang ang sinabi ni Bianca, matagal na tayong nag bubulag bulagan sa mga ginagawa ng mga informal settlers. Malaking pondo ang napupunta para ma ilagay sila sa maayos na mga tirahan…at ano ang ginagawa nila? Binebenta ang bahay at lupa at bumabalik sa pag squat…karamihan sa kanila pinipili na wag mag trabaho o kaya naman pumasok sa trabaho na madali ang pera ngunit madaling maubos kse illegal…karamahian pa sa kanila maraming bisyo kaya ang mga anak imbis mag aral mg aasawa na lang. Kaya paulit ulit lng ang istorya ng buhay…

      Buti naman kahit papano ngayon may nagsalita , at ang mga tao nakinig. Kahit pa negatibo o positibo ang reaksyon kahit papano tinamaan tayong lahat sa sitwasyon.
